The rumor I read was that in addition to there being the question of the NCAA's authority, there's evidence that a vote went 19-2 against giving Penn State the death penalty, but Emmert went and told Penn State reps that there was momentum to issue the death penalty, so they'd better agree to the terms they did. Apparently, this opens the NCAA to some kind of good faith lawsuit.

Sounds like the terms of this settlement restore the vacated wins and keep the $60 million in Pennsylvania in exchange for an agreement that the NCAA did have the authority to levy the penalties and did act in good faith.

Penn State fans seem unhappy. They don't want a settlement, they want the emails that show what happened and how the NCAA operates.

Apparently, the NCAA chair didn't actually read the Freeh report before imposing the sanctions.

...but Penn St just signed an agreement saying that the NCAA did have the authority.

Apparently we're a part of this new agreement:
Penn State and the NCAA will enter into a new Athletics Integrity Agreement that (with concurrence of the Big Ten) includes best practices with which the university is committed to comply and that provides for the university to continue to retain the services of Sen. George Mitchell and his firm to support the university's activities under the Athletics Integrity Agreement and in the areas of compliance, ethics and integrity.

They see this as a victory, but end the statement with this: "Through our pending litigation, we intend to continue the job of uncovering the full truth in this case. "

reading that makes me sick. The NCAA didn't handle it correctly but the truth is Joe PA was partially responsible for what happened and the reason they didn't report it was to protect the football program.
