Smith facing Gun charges

Some new details...

Smith was travelling at more than 2x the speed limit, pulled over for doing 52 in a 25mph zone.

Doesn't appear this is a case of "Officer: 'do you have any weapons in the car?' Smith: 'yes sir, I have a hand gun in the glove box.'"

Per the piece (pun intended) "As the officer approached the car, Smith moved to put his Glock 19 handgun behind his seat." Looks like the police found the pistol after watching him stash it behind him.

Also, the gun was loaded with a 24-round clip and Smith was found to have a 30-round magazine and a 15-round magazine in his pockets.

Warde Manuel on why Smith will not be suspended, "He is not and never has been considered a threat to the University or community. Based on the information communicated to us, we will continue to allow the judicial process to play out. Mazi will continue to participate as a member of the team.?

Mazi just had a bunch of key tackles in the Iowa game, didn?t he?

Oh, wait, check that - it was Purdue this year.

These B1G Conference Championship Game wins for Michigan are becoming so commonplace they?re starting to feel like they?re running together.

wouldn't know, I didn't watch either one.

If you can have a 24 round magazine, why not a 30, ammiright?

it's LOL funny that "dumbass pro-gun Conservative guy" on the politics board is trying to play "Pearl-clutching 50-year-old anti-gun woman" on the Michigan board with a straight face.

Is MLive a spin-free source? In reading the two, I don't see much difference in any material facts between them. The differences seem to be deflection at best by Smith's attorney. According to MLive his lawyer is disputing Smith's rate of speed but has no proof. Even if he's correct, 40 in a 25 is still pretty fast particularly at 9:30 in the morning. The only other dispute is whether the 24 round magazine was actually in the gun, which is conjecture and is a distinction without a difference. Again according to MLive, Smith's attorney says the police report clearly states the magazines were found separate but the AA police said the report doesn't clarify whether the gun was loaded or not. At a minimum, the magazine in question was found with the gun and he had 2 more on his person. My guess is it was in the gun, otherwise why not just keep it in his pocket like the other two loaded clips? But again, I don't think it matters, all that means is it would take a few seconds longer to shoot someone. The H.I. McDonnough defense is not based in actual law.

The MLive piece is identical in every major respect including the fact that Smith attempted to stash the weapon behind his seat.

Spun: Gun loaded (it hasn't bothered to amend the account from M live that it quoted, but the link to the story itself is updated)
M live: Gun loaded is not confirmed (not concerned about the atty comment)

I think that whether the gun is loaded or not as a significant distinction.

Spun: Gun "stashed"
M Live: Gun "put the gun in the back seat."

Words matter, even those not written. Spin splashed its version and left people to click on the link for the details, which it misrepresented.

seems like splitting hairs to me. I don't interpret the Spun article to be particularly editorial (nor was my post meant to be), they're just reporting updates to the story. They even quote a couple paragraphs from MLive in the piece.

If the ammunition was locked in the truck bed away from the gun, I might agree that's different from a loaded weapon, but when you have 3 clips with 69 rounds of ammo and a gun, I don't think there's a material difference whether one clip was "with" the gun or "in" the gun.

Calling it stashing when he took an illegally concealed gun and moved to put it under his seat when he got pulled over doesn't seem like an egregious mischaracterization of his actions or motives. That doesn't seem like a perfectly normal thing - there's a motive for it and that's to hide or "stash" the weapon somewhere other than on him. If it was anyone else - unknown civilian or an OSU or MSU football player, I suspect the interpretation of the same actions would be different.

In a home invasion situation, I'd want more than one clip of 10, and I wouldn't want to spend time reloading.

Why stop there? Ensure you never leave your sandbagged bunker with a single entrance that has a 0.50 cal Browning trained on it, with a minimum of 1,000 rounds belted and ready to feed into it AT ALL TIMES.

As you can see, I too like to spend time contemplating a scenario that has a 0.0000001% chance of happening to me.

Including the quote about the gun being loaded, which Mlive has retracted. Spun hasn't yet. Other third-party sources have.

When you pull the trigger of an unloaded gun, what happens?

Smith "moved to put the gun behind the front seat" and "in the back seat", to quote the Mlive article. No mention of under the seat, or "stashing". No real confirmation if he ever completed his action. The story in no way indicates where the officer found the gun, except for in the car.

You need to me more vigilant, IMO. At least have a plan for that situation. And walk serpentine.

Depends.

Is the individual in question Alec Baldwin?

so you don't think you could fend off a home invader on your first 10 shots? You need to hit the gun range ;)

where have I played "Pearl-clutching 50-year-old anti-gun woman" on this board? Is making a joke and pointing out there isn't much difference between 24 and 30 rounds somehow advocating for gun control?

The only dumbass here is you...
